Attachment Terms and Conditions of Authorization September 16, 2005 1 SES Americom, Inc.‘s (°SES Americom") application, SAT:L.OA—20050622—00133 and SAT—AMD—20050908—00175, Call Sign S2676, ARE GRANTED. Accordingly, SES Americom is authorized to Iaunch and operate its AMC—21 Ku—Band FSS satelite at t125° W.L. orbial location in the 11.7—12.2 GHz (space—to—Rarth), and 14.0—14.5 GHz (Earthto—space)frequency bands in accordance with the terms, conditions, and technical specifications set forth in iss applications, this Attachment, and the Federal Communication Commission‘s ("Commission) Rules. 2. The AMC—21 satellite must be constructed, launched, and placed into operation in accordance with the technical parameters and terms and conditions ofthis authorization by these specified time periods following the date of authorization: Execute a binding contract for construction within one year (9/16/2006) seo se Complete the Critical Design Review within two years (9/16/2007) Commence construction within three years (9/162008) Launch and begin operations within five years (9/16/2010) SES Americom mustfile a bond with the Commission in the amount of $3 million, pursuant to the procedures set forth in Public Notice, DA 03— 2602, 18 FCC Red 16283 (2003), within 30 days othe date of this grant (10/16/2005). Failure to meet any of these dates shall render this authorization null and void. See 47 C.FR. §§25.161 and 25.164. 3. SBS Americom is authorized to provide diectto—home services over the AMC—21 satelte, in the Ku—band, consistent with th rationale outlned in SES Americom, Inc. Applications for Modification of Fixed—SateliteService Space Station Licenses, Order and Authorization, 18 FCC Red 16589 (2003). 4. SBS Americom shall prepare the necessaryinformation,as may be required,for submission tothe Internationa! Telecommunication Union ("IT®)to initiate and complete the advance publication,intermational coordination, due diligence, and notification process ofthis space station,in accordance with the ITU Radio Regulations. SES Americom shallbe held responsiblefor all ost recovery fees associated withthese TTflings. We also note that no protectionfrom interference caused by radio stations authorized by other administrations is swaranteed unless coordination and notification procedures are timely completed or, with espect to individual administrations, by successfully completing coordination agreements. Any radio station authorization for which coordination has not been completed may be subject t additional terms and conditions as required t effect coordination ofthe frequency assignments ofother administrations. See 47 CFR. § 25.111(b).

SBS Americom must provide a written statement to the Commission within 60 days of the date of this grant thatidentifes any known satelites located at, orplanned to be located at, SES Americom‘s assigned orbiallocation, or assigned in the vicinity ofthat location such that the station—keeping volume oftrespective satelites might overlap,and that states the measures that wll betaken to prevent n—orbit cllisions with such satelites. This statement should address any Hicensed FCC systems, or any systems applied fo and under consideration by the FCC. The statement need notaddress every filing with the TTU that meetsthese critera, but should assess and address any systems reflected in ITU fiimgs that arein operation orthat SES Americom believes may be progressing toward launch, eg., by the appearance ofthe system on a launch yehicle manifest If SES Americom electsto rely on coordination with other operators to prevent in—orbit callsions,it shall provide a statement as t the manner in whichsuch coordination will be effected. 7. SES Americom is afforded thity days from the date of adoption of this grant and auth on to declinethis uthorization as conditioned. Failure t respond within this period will constiure formal acceptance ofthe authorization as conditioned. 8. This grantis issued pursuant toSection 0.261 of the Commission‘sruleson delegated authority, 47 C.FR. §0.261, and is effective upon adoption. Petitions for reconsideration under Section 1.106 or applications for review under Section 1.1 15 of the Commission‘s rules, 47 CR §§ 1.106,1.115, may be filed within 30 daysof the date of the public notice indicating that this action was taken.
