Modification of blanket license for operation of mobile terminals with MSAT- 1 (E980 179)

In these filings MSV requests authority to operate Ancillary Terrestrial Component (“ATC”)
stations in the United States in connection with its existing L-band MSS satellite and the L-band
MSS satellite currently operated by Mobile Satellite Ventures (Canada) Inc. under Canadian
license. MSY also requests authority for ATC operation in connection with proposed next-
generation replacements for those existing satellites. The proposed ATC base stations and
mobile terminals would transmit in portions of the 1525-1559 MHz and 1626.5-1660.5 MHz
bands that have been internationally coordinated for the MSV and MSV Canada MSS systems.
MSV requests waivers of the following provisions of the Commission’s rules pertaining to ATC
operation:


        47 CFR 9 25.149(b)(2)(ii)
        47 CFR 9 25.253(a)(2)
        47 CFR 3 25.253(c)
        47 CFR 0 25.253(d)(1)-(5)
        47 CFR 8 25.253(e).
MSV also requests a ruling that its proposed ATC system will not be subject to the peak traffic
limit specified in Paragraph 188 of the ATC Report and Order.’

Other matters of record MSV presented a supplemental written showing in a meeting with staff
from the FCC’s International Bureau on December 1 1 , 2003 and filed a copy with an ex parte
notice dated December 12, 2003. In an email dated December 16,2003, the Deputy Chief of the
International Bureau’s Policy Division asked MSV to submit additional information pertaining to
the waiver requests. In a responsive letter dated December 30, 2003, counsel for MSV submitted
further information, requesting that some of the information be treated as confidential and
providing redacted copies for the public application files. In an inquiry letter dated January 2 1 ,
2004, the Chief of the International Bureau’s Satellite Division advised MSV that certain further
information was needed to facilitate assessment of its waiver requests. MSV filed another ex
parte notice on January 22, 2004 pertaining to demonstration of an interference cancellation
device. MSV filed further information in response to the January 2 1 inquiry letter on February 4,
2004.

The status of this proceeding is “permit-but-disclose” for purposes of the Commission’s ex parte
rules. See 47 CFR 0 1.1200 et seq.
