Mazer, Esq., dated September 28, 2000, Constellation Communications Holdings, Inc. ("CCHI") provides herewith copies of all executed contracts for satellite construction, including all amendments and related financing agreements, pertaining to the license granted to Constellation Communications, Inc. on July 1, 1997, to construct, launch and operate a Big LEO satellite constellation. See Constellation Communications, Inc., 12 FCC Red 9651 (1997). A list of the enclosed contracts is attached to this letter. Pursuant to Sections 0.457 and 0.459 of the Commiuission‘s Rules, CCHI requests that this information be treated as confidential documents not subject to public inspection. This information contains sensitive commercial and financial information concerning CCHI‘s business, which the company believes has significant competitive value. Consistent with Section 0.457(d) of the Commission‘s Rules, CCHI considers such information to be confidential and would not customarily disclose such information to competitors. See 47 C.F.R. § 0.457(d). Public disclosure of such information would place CCHI at a significant competitive disadvantage in the marketplace, and confidential treatment of this information by the Commission will not adversely affect any interested party.
