In the Matter of wl se se se s au 22y the Application of AMSC SUBSIDIARY CORPORATION File No. 3—DSS—AMEND—93 for Authority to Construct, Launch and Operate AMSC—1 To: Chief, Satellite & Radiocommunication Division International Bureau AMENDMENT AMSC Subsidiary Corporation ("AMSC")*‘ hereby amends the above—referenced application to change the frequencies for telemetry, tracking and control ("TT&C") while the satellite is in transfer orbit to conform to the TT&C frequencies to be used while the satellite is in orbit. AMSC submits the following information in support of this request: (a) The name and address of the applicant is: AMSC Subsidiary Corporation 10802 Parkridge Boulevard Reston, VA 22091 AMSC is the licensee of the U.S. MSS system. See Memorandunm Opinion, Order and Authorization, 4 FCC Red 6041 (1989), rev‘da in part, Aeronautical Radio, Inc. v. FCC, 928 F.2d 428 (D.C. AMSC is authorized to operate AMSC—1 at 12197.75 MHz and 12195.25 MHz (space—to—Earth) for telemetry transmit and at 14497 MHz (Earth—to—space) for command receive during launch and up until commencement of on—station operation. Memorandunm Opinion & Order, 8 FCC Red. 4040, 4046 (1993) . 2. On October 20, 1992, AMSC filed a request to eliminate the use of the 11/13 GHz band for TT&C operations and instead use only the 12/14 GHz band for on—station TT&C operations. File No. 3—DSS—AMEND—93. AMSC also requested authority to construct and operate TT&C for AMSC—1 during on—station operations at 11700 .5 MHz and 11701.0 MHz (telemetry transmit) and at 14000.5 MHz and 14499.5 MHz (command receive). The Commission has not yet ruled on this unopposed application.* l AMSC was granted a Section 319 (d) waiver to construct the satellite at its own risk in conformance with this request. See Order, 23—DSS—MISC—92 (May 27, 1993). Since the filing of this last amendment, the spacecraft contractor has changed the manufacturer of the L—band antenna from Lockheed Corporation to Hughes Aerospace. This change in contractors does not materially affect the technical parameters of AMSC—1.

—3 — 3. The purpose of this Amendment is to conform the TT&C frequencies that will be used during transfer orbit operations with those that will be used when the satellite is on—station. The frequencies requested herein (14499.5 MHz, 11700.5 MHz and 11701.0 MHz) are identical to those specified in the October 20, 1992 filing. 4. AMSC will coordinate with other satellite operators as necessary to preclude causing harmful interference to their systems. As is routine with in—orbit transfer coordination, thirty days prior to launch of AMSC—1, AMSC will notify operators of the satellites that AMSC—1 will pass during the approximately five—day transfer orbit phase. AMSC will advise the other satellite operators that AMSC—1 and its ground facilities will not radiate when the satellite is within one degree of another satellite. Statement of Waiver AMSC waives any claim to the use of any particular frequency or of the electromagnetic spectrum as against the requlatory power of the Untied States because of the previous use of the same, whether by license or otherwise, and requests an authorization in accordance with this application.

—4 — Drug Certification The applicant certifies that, pursuant to section 5301 of the Anti—Drug Abuse Act of 1988, 21 U.S.C. 853a, no party to the application is subject to a denial of federal benefits pursuant to that section.
