Through an administrative oversight, VoiceStream neglected to obtain the requisite Section 214 authority needed to provide subscribers with the capability of completing international calls from their wireless telephones. This application, which is incorporated herein by this reference, is subject to streamlined processing pursuant to Section 63.12 of the Commission‘s Rules. VoiceStream is currently seeking Commussion consent to mergers with Omnipoint Corporation ("Omnipoint") and Aerial Communications, Inc. ("Aerial") respectively, that will result in the creation of a nationwide GSM PCS network able to compete with national CDMAand TDMA networks.* Both Omnipoint and Aerial are authorized to operate as international resale carriers pursuant to Section 214 of the Act*, and it is anticipated that these authorizations will be transferred to the newly created parent company for the merged entities, VoiceStream Wireless Holding Corporation, following the closing. VoiceStream seeks temporary authority so that it may remain in compliance with Section 214 of the Act until the Commission acts upon the Section 214 application filed herewith. For the foregoing reasons, VoiceStream submits that the public interest, convenience and necessity would befurthered by grant of VoiceStream‘s request for temporary authority to operate as an international resale carrier.
