Specifically, the following applications have been withdrawn: (1) the application seeking consent to transfer control of PCCW‘s Section 214 licensee subsidiaries to Pacific Century Regional Developments Limited (File N‘.-..mifiamd (2) the application to extend PCCW‘s Special Temporary Authority (whichis set to expire April 29) to effectuate that transfer of control (File No. ITC—STA—20090420—00168). The Hong Kong Court of Appeal allowed the Hong Kong Securities and Futures Commission to appeal a lower court‘s approval of the proposal to privatize PCCW. As a result, certain conditions of the privatization proposal were not fulfilled by the"long stop" date of April 23, 2009 and the proposal automatically lapsed.
