Susan——In response to the International Bureau staff‘s request, this is to confirm certain information contained in
Exhibit 1 to DataPath, Inc.‘s ("DataPath") July 14, 2006 amendment. Exhibit 1 contained a list of entities that
acquired DataPath‘s shares in the recent offering transaction that are foreign organized or that primarily do
business abroad. DataPath respectfully requested confidential treatment of Exhibit 1.

Specifically, this is to confirm that such foreign shareholders acquired approximately 20 percent of DataPath‘s
shares in the offering transaction. One foreign shareholder acquired approximately 4.76 percent of DataPath‘s
shares, and another foreign shareholder acquired approximately 2.32 percent of DataPath‘s shares. All other
foreign shareholders acquired less than 1 percent of DataPath‘s shares.
