We referred these two applications for your review under Ref. 2008—55, December 19, 2008. (Attached). Applicants acknowledge that thegrant of the STAs will not prejudice any action the Commission may take on the underlying applications. Applicants further acknowledge that the STAs canbe revoked by the Commission upon its own motion without a hearing. : In addition, Applicants request that the Commission condition the grant of the STAs request on compliance with the terms of the Agreement dated as of November 29, 2001, by and between PCCW, Reach Ltd. and Telstra Corporation Limited, on the one hand, and the DOJ and Federal Bureau of Investigation, on the other.
