                                           NOTICE OF DISMISSAL

       On November 30, 2006, Cognigen Networks, Inc. ("Cognigen") filed a Domestic 214
application for the transfer of certain assets of Cognigento Acceris Management and
Acquisition, LLC ("Acceris") with the Federal Communications Commission‘s Wireline
Competition Bureau. For the reasons discussed below, we dismiss your application without
prejudice to refiling.

        Under 47 C.F.R. § 1.1910, applications or other requests for benefits filed with the
Commission are examined to determine whether the applicant is delinquent in any non—tax debt
owed to the Commission.‘ OnDecember22,2006, Cognigen was notified that the corporation
was delinguent on the paymentof debts owed to the Federal Communications Commission."
The letter informed Cognigen that, if full payment or satisfactory arrangement to pay the
delinquent debt was not made within 30 days of the date of the letter, the application or other
request for benefit would be dismissed. The Commiussion has not received payment of the debts
identified in the debt letters, nor have satisfactory payment arrangements been made.

         Accordingly, pursuant to 47 C.F.R. § 1.1910(b)(3) and the Commission‘s rules on
