Washington, D.C. 20554 Attn: International Bureau Re: Withdrawal of Application, File No. ITC-214-20100907-00357 By its counsel, Toronto Asia Tele Access Telecom, aka Tata Telecom INC ("Applicant"), hereby notifies the Commission, that the Application to Provide International Facilities-Based and Resold Services to All International Points, File No. ITC-214-20100907-00357, filed August 18, 2010 ("Application") is withdrawn without prejudice. Applicant is currently the plaintiff in litigation before the U.S. District Court for the Western District of Washington ("District Court"). See Toronto Asia Tele Access Telecom Inc. and Manmohan Singh Thamber v. Tata Sons Limited, No. CV 09-01356 RSM (W.D. Wash. Filed Sep. 24, 2009) ("Washington Litigation"). On June 14, 2011, a Notice of Settlement was filed informing the District Court that the parties have reached a settlement agreement in principal. After settlement has concluded, the Washington Litigation will be dismissed with prejudice. As a result of the settlement, Applicant will no longer maintain rights in the name Tata Telecom INC. As such, Applicant no longer seeks authority to provide services under this name. Applicant reserves its right to re-file its Application under a new name once selected if it is determined that Section 214 authority is required.
