Our File: CC-4465-266-4 I am legal counsel employed by SaskTel and counsel for Navigata Communications Ltd. of North Vancouver, B.C. SaskTel is headquartered in Regina. Saskatchewan, Canada. SaskTel and Navigata are affiliates. Effective April 3oth,2006, Navigata has ceased to actively carry on business. Ail of its assets were transferred and are now owned by SaskTel. SaskTel is carrying on the business formerly carried on by Navigata, including its U S . operations. Navigata remains a separate legal entity from SaskTel but is a sales agent only for services of SaskTel that it selis outside the Province of Saskatchewan. Navigata will no ionger have any revenues. Accordingly, enclosed are the following: 1. Section 214 Special Temporary Authority application filed on SaskTel's behalf; and 2. Since a final determination of the Section 214 International License Application filed by Navigata Communications Ltd. in November 2004 (File# ITC-224-20041115-0043) has not yet been made, and given SaskTe! is the successor to Navigata as i have described above, we request that such Section 214 License Application be amended to substitute SaskTei as the license appiicant in the place of Navigata Communications Lid. There is no Ltd. or lnc. or Corp. in our legal name as SaskTel is a corporate body created by its own enabling legislation of the Province of Saskatchewan. Canada. Our thinking was that the Section 214 License Application by Navigata would have been granted by now and that we would then be able to pursue a transfer and assignment of that license to SaskTel from Navigata. Since that has not happened we pursue the indicated course of action noted in this letter (SaskTel applying for an STA and amending the existing Section 214 License Application), after consulting with the International Policy Bureau of the F.C.C. We trust this is satisfactory.
