The grant of GigaRed‘s application will serve the public interest, convenience, and necessity by fostering competition in the market for international services, which can be expected to result in more efficient and innovative international telecommunications offerings, lower prices, and better service for consumers.

Service Authority Requested GigaRed requests Section 214 authority to operate as a facilities—based carrier pursuant to Section 63.18(e)(1) of the Commission‘s rules and to operate as a resale carrier pursuant to Section 63.18(e)(2) of the Commuission‘s rules. GigaRed hereby certifies that it will comply with the terms and conditions contained in Sections 63.21, 63.22, and 63.23 of the Commission‘s rules. F. No Special Concessions GigaRed hereby certifies that is has not agreedto accept special concessions directly or indirectly from any foreign carrier with respect to any U.S. international route where the foreign carrier possesses market power on the foreign end of the route and will not enter into such agreements in the future. Anti—Drug Certification Pursuant to Sections 1.2001 through 1._2_003 of the Commission‘s rules, GigaRed hereby certifies that no party to this application is subject to a denial of federal benefits pursuant to Section 5301 of the Anti—Drug Abuse Act of 1988, 21 U.S.C. § §53a. P. Streamlined Processing This application qualifies for streamlined processing pursuant to Section 63.12 ofthe Commuission‘s rules because GigaRed is not affiliated with a foreign carrier with market power or a dominant U.S. carrier, and the majority of its equity is owned by US citizens.

Only two preferred unit holders have an interest of ten percent or more —— Madison Dearbom Capital Pariners IIJ, L.P, ("MDCP") and LPL Investment Group, Inc. ("LPL"). MDCP entities are controlled its the genecral partner, a U,.S. entity. Only one entity directly or indirectly owns ten percent or more of MDCP: the California State Teachers Retirement system owns a 13.8% limited partnership interest,. LPL is owned by a partnership, of which Lawrence F. DeGéorge, a U.S. citizen, owns all of the general partner entity and is the sole limited partner.
