                                ORDER, AUTHORIZATION AND CERTIFICATE

**7456 By the Chief, International Facilities Division:
1. The above—captioned application, filed on August 21, 1990 by GTE Hawaiian Telephone Company
Incorporated (HTC), requests authority pursuant to Section 214 of the Communications Act of 1934,
as amended, to acquire and operate facilities for direct service between Hawaii and India. The
application was placed on public notice on September 5, 1990. No comments were received. Upon
consideration of the application, IT IS HEREBY CERTIFIED that the present and future public
convenience and necessity require the provision of direct service between Hawaii and India by HTC.
2. Accordingly, IT IS ORDERED that application File No. I—T—C—90—166 IS GRANTED, and HTC is
authorized to:
a. lease from Comsat and operate three voice—grade satellite half—circuits between an appropriate
earth station in Hawaii and an appropriate satellite over the Pacific Ocean, connecting with similar
circuits between an earth station in Malaysia furnished by HTC‘s correspondent in India;
b. lease a one—half interest in three voice—grade terrestrial microwave circuits interconnecting the
Kuantan Earth Station and Penang Cable Station in Malaysia;
c. acquire, on an Indefeasible Right of User (IRU) basis, a one—half interest in and operate five voice—
grade circuits in the I0COM cable between Malaysia and India [FN1], and
d. use said facilities to provide HTC‘s regularly authorized services between Hawaii and India and
beyond.
3. The Commission retains jurisdiction over this matter to reallocate circuits in the satellite system
among the various international common carriers and other authorized users as required to ensure
nondiscriminatory use of, and equitable access to, the communications satellite system.
4. No material changes inconsistent with this or any other relevant Commission order shall be made
before final execution of an operating agreement between HTC and its correspondent in India and a
copy of the agreement shall be filed with the Commission within 30 days of its execution.
5. This order is issued under Section 0.291 of the Commission‘s Rules and—@@Q@Mflmfi!@i@m

Commission‘s Rules may be filed within 30 days of the date of public notice of this order (see Section
