Special Temporary Authority application - Explanation

Please explain in the area below why an STA is necessary:
This request for an STA is submitted by the Nuclear Energy Institute (?NEI?) and is a further request for extension of the existing STA originally granted by the Commission to NEI on April 7, 2005. This STA request is again submitted on behalf of commercial nuclear power plant licensees (holding licenses under 10 C.F.R. Part 50). Commission approval of NEI?s request is necessary to allow these licensed nuclear facilities to continue to use certain Telex Communications, Inc. (?Telex?) equipment, authorized pursuant to Part 74 of the Commission?s rules, while the Commission considers a pending Waiver Request filed by NEI on July 20, 2005 (?Request?), and otherwise determines the most appropriate means to provide NEI members with effective communications to enhance worker safety during the conduct of highly sensitive operations at the nuclear plant facilities. This includes the refueling of nuclear reactors, critical maintenance and refurbishment of plant components and systems, and the removal and storage of radioactive waste. The Telex equipment, with its hands-free, full duplex, high voice quality performance features, is extremely important to reducing worker radiation exposure and advancing other industrial safety and public health and safety objectives. The present STA expires when many nuclear generating facilities are beginning or in the midst of refueling outages, when the use of this equipment is most critical. Based upon information from its nuclear power reactor licensee members, NEI avers that it would be virtually impossible for the nuclear facilities to obtain replacement communications systems and receive any required operating licenses, prior to the expiration of the current STA. Over the past several months, following a meeting with representatives of Chairman Martin, NEI has been in active negotiations with several broadcast parties that objected to NEI?s Request. Currently, these parties and NEI are actively seeking to develop a mutually agreeable ?consensus plan? for NEI Members to continue to use the Telex Equipment, subject to certain limitations and timetables. Significant progress has been made toward developing such a plan and NEI is optimistic that these discussions will result in a ?consensus plan? within the next month or so, which can then be presented to the Commission for its consideration in connection with the Request. In the meantime, the Commission?s approval of the instant STA request is critical to meet the communication and worker/public safety requirements of these nuclear facilities.
