Please explain in the area below why an STA is necessary:
Temporary need for authority to begin operation of facility in new bands pending Commission decision on modification application filed to add bands on permanent bais. Flarion Technologies, Inc. (?Flarion?) herein requests special temporary authorization (?STA?), pursuant to Section 5.61 of the Commission?s rules, to operate an experimental broadband wireless communications system prototype based on Flarion?s flash-OFDM technology for up to one hundred eighty (180) days. Flarion recently filed an application for modification of its permanent experimental authorization (File No. 0011-EX-ML-2003; Call Sign WC2XLF) seeking authority to operate its prototype radio facility using additional frequencies in the 1.9 GHz, 2.1 GHz, and 2.3 GHz bands. Flarion needs to have the subject device ready for experimental use in order to demonstrate and further test its technology. Based on conversations with the OET?s staff, given the urgency of Flarion?s need, it seems the STA request can be processed more quickly than Flarion?s application for modification of its experimental authority. Accordingly, Flarion is herein seeking STA to operate its experimental device on frequencies in only the 1.9 GHz and 2.1 GHz bands pending Commission action on its modification application. Flarion has been developing a new broadband mobile data communications system in the 700 MHz band and is in the process of expanding its existing experimental program to include the use of 1.9 GHz PCS, 2.1 GHz, and 2.3 GHz WCS frequencies. Only the 1.9 GHz and 2.1 GHz bands are however within the scope of the instant STA request. Flarion seeks to operate its equipment on the proposed new bands in and around the location of its headquarters in Bedminster, NJ. Flarion?s request for STA is supported by good cause. Flarion seeks to develop products that will ultimately result in the more efficient use of the radio spectrum. Demonstrating the device before interested parties allows Flarion to receive important feedback, enabling the company to continue to make modifications to its system before marketing the device. Furthermore, Flarion is at a stage in its experimental program wherein it is critical to understand the performance of the system under real world conditions, which conditions cannot be effectively modeled in a lab setting. Issuance of the instant STA will facilitate Flarion in the continuation of its experimental program, especially with regard to the collection of relevant data pertaining to propagation, frequency reuse, mobility user behavior, traffic mix, environmental, and system loading requirements of the system. Grant of the requested STA also would present no risk of interference to other users. Flarion has been in the process of coordinating its proposed operations with other users licensed in the same band in order to select channels that will not interfere with those licensees. Accordingly, and for good cause shown, Flarion respectfully requests an STA for up to 180 days to commence operations in the manner herein described.
