Explanation
Please explain in the area below why an STA is necessary:
This is a fourth request for extension of the present STA, first granted by the Commission April 7, 2003, and three times previously extended. The present STA is scheduled to expire April 7, 2005. On May 6, 2003, Telex filed a Request for Special Waiver with the Chief, Public Safety and Private Wireless Division, WTB, to obtain permanent authority for Part 90 eligibles for business/industrial licenses to deploy the subject wireless headsets and intercom products within operating nuclear power facilities in the continental United States. The Public Safety and Critical Infrastructure Division denied this waiver request on November 29, 2004. However, Telex timely filed a Petition for Reconsideration December 29, 2004 which is presently pending. Therefore, this third extension of the present STA is necessary to continue to permit immediate, temporary use of certain Telex wireless headsets and intercom products within operating nuclear power facilities in the Continental United States, pending Commission action on eligibility waivers for nuclear facility licensing in the United States to license and deploy these devices on a permanent basis. The present STA expires in the midst of refueling operations of many or most nuclear power generating facilities when the use of these headsets is most critical. It would be impossible for these facilities to obtain replacement communications systems, obtain licenses for them, and conduct the refueling operations in the time available absent the requested extension. The absolute need for the use of the presently deployed headset systems necessitates the early filing of this STA extension request, so that the nuclear power facilities will have assurance that they will be able to conduct their refueling operations in April as scheduled. As well, the extension of this STA is critical in order to permit Telex to prosecute its Petition for Reconsideration. Denial of extension of the STA would be tantamount to denial of the Petition for Reconsideration, inasmuch as the devices now deployed would have to be somehow replaced if the current STA is terminated during the pendency of the Petition for Reconsideration.
