                                           Applicant Eligibility

Pivotal Commware (“Pivotal”) is eligible for program experimental authority pursuant to Section 5.302
of the Commission’s Rules.

Pivotal is a manufacturer that integrates radio frequency equipment into its end product.

The radiofrequency experimentation will be conducted in a defined geographic area under Pivotal’s
control. Specifically, RF experimentation will be conducted at low power outside Pivotal’s headquarters
located at 10801 120th Avenue, NE, Kirkland, Washington. The geographic coordinates are 47-41-47
North/122-10-56 West.

Pivotal has demonstrated expertise in radio spectrum management and has in place institutional
processes to monitor and effectively manage a wide variety of research projects.

Pivotal’s senior management brings decades of experience in RF development and management.

•   Brian Deutsch, CEO, was the founding CEO of Wavtrace, a broadband wireless equipment provider
    acquired by Harris Corporation in 2000. More recently, Deutsch served as turnaround CEO at
    Aperto Networks and EVP at BSQUARE. Deutsch spent six years with Motorola, worked for NASA at
    Kennedy Space Center, and has been awarded many U.S. patents. He received his BS in Electrical
    Engineering from the University of Miami.

•   Jay McCandless, Chief RF Engineer, is an expert in microwave and mmWave circuit and antenna
    design. McCandless brings several decades of experience in advanced satellite communications
    systems as well as architectures for low cost phased array antennas. He received his BS and MS in
    Electrical Engineering from UCLA.

•   Eric Black, CTO, received his Ph.D. in Electrical and Computer Engineering from Carnegie Mellon in
    2010. Black then worked on several DARPA and other defense projects at Boeing Research and
    Technology.

Eric Black, CTO, will be responsible for managing Pivotal’s RF testing. Black supervises a staff of
engineers, including at least one engineer with specific experience in compliance with FCC’s rules,
including the rules governing experimental authorizations.
