I just wanted to update you on the status of the other applications associated with this transaction. Today, the Wireless Bureau granted the application for the pro forma transfer of control of private radio licenses held by New Cingular Wireless PCS, LLC (file number 0004064830). There are no further pending applications associated with this transaction except for the experimental license transfer. As I mentioned in our telephone conversation, I will be out of the office tomorrow but will be on e-mail and will also check voice mail regularly should you need anything further from us. We made a filing for a similar transfer of control around this time last year, and John Kennedy was our point of contact. He indicated that you were the appropriate contact in OET this time around. Last year, our instructions were to notify your office once the other applications associated with the transaction had been granted, and then OET would grant the experimental license transfer. At this point, we have all of the needed authorizations to close the transaction except for this one, and we were hoping we might get you to go ahead and act on the Form 703. The International Bureau granted our earth station transfer on the 22nd (see http://licensing.fcc.gov/cgi-bin/ws.exe/prod/ib/forms/reports/swr031b.hts? q_set=V_SITE_ANTENNA_FREQ.file_numberC/File+Number/% 3D/SEST/C2009121601584&prepare=&column=V_SITE_ANTENNA_FREQ.file_numberC/File+Number) and our VSAT transfer yesterday, the 28th, (see http://licensing.fcc.gov/cgi-bin/ws.exe/prod/ib/forms/reports/swr031b.hts? q_set=V_SITE_ANTENNA_FREQ.file_numberC/File+Number/% 3D/SEST/C2009121601588&prepare=&column=V_SITE_ANTENNA_FREQ.file_numberC/File+Number). Under Section 90.159(c), we also have a conditional authority to close the transfer of control for the Wireless Bureau private radio licenses, which is automatic upon filing (the file number of that application is 0004064830). All other filings related to this transaction are forbearance notifications which need only be filed within the 30-day period post-consummation, and will be filed next month. Our client wants to consummate this internal reorganization on December 31, so we were hoping that you might be able to move forward on the grant of the experimental transfer.
