NYNEX Science and Technology, Inc. is requesting the renewal and revision of Experimental
Licenses it has held since 1990, per 47 CFR Part 5. During this period, NYNEX Science and
Technology, Inc. has held Experimental Licenses for various subparts of Part 5 and a broad range of
frequencies. As part of this renewal process, NYNEX wishes to consolidate three of these licenses,
KF2XBX, KF2XBW, KF2XEG into two, covering Parts 5.202 [a, cJ and 5.202 [d, f, i, jl,
respectively. Call Sign KF2XBX, as covered in this application, will be for Parts 5.202 [a, c]. Call
Sign KF2XBW will be for Parts 5.202 [d, f, i, j]. The Part 5.202 [i] request is a revised addition to
the previous license. Upon grant of KF2XBX and KF2XBW, KF2XEG can be cancelled.                    (’ ‘4’

In addition, NYNEX Science and Technology, Inc. wants to consolidate the licenses in order th:é%             )
each frequency band request appear on each license.

NYNEX Science and Technology, Inc.‘s use of Experimental radio licenses continues to be
comprehensive. Its programs need permission for radiations as described in Part 5.202. Those uses
of Part 5.202 [a, c] will permit continued experimentation in scientific or technical radio research of
the HF, VHF, UHF, and microwave bands listed in Exhibit 2. Scientific radio research is used to
advance leading edge technology and enrich the body of public knowledge; concurrent with the
fundamental studies will be the development or radio techniques to implement the findings of such
investigations. Experimental radio programs of NYNEX Science and Technology, Inc. include
testing of equipment in connection with type approval, and development of radio techniques and
engineering or operational information for existing or new services (Part 5.202 [i]).    The
experimentation program will also require technical demonstrations of equipment or techniques
(Part 5.202 [d]), and demonstration of equipment to prospective purchasers for proposed stations in
existing services by persons engaged in the business of selling radio equipment (Part 5.202 [f]).
Limited marketing trials may be conducted [Part 5.202 [i}).

NYNEX requests that the license, KF2XBX, be based for the Continental US. NYNEX further
wishes to modify the licenses to be more general in the 2500—2655, 2655—2690, 23.0—23.6 and 27.5—
29.5, 39.5—40.5, 40.5—42.5 and 59—64 GHz bands. As the Commission is aware, NYNEX is planning
to introduce Digital MMDS services in the two 2 GHz bands, and will therefore be conducting tests
of various vendor and experimental radio (TV) systems in those bands. Further, the experimentation
program will investigate the factors associated with the use of microwave technologies as a
transmission medium for Video on Demand (VOD) applications. Some work may involve the use of
directional antennas.

NYNEX has been a responsible user of its FCC Experimental licenses.            As the Commission is
aware, NYNEX conducted several tests in the 1850—1990 MHz band and provided timely,
informative FCC Experimental License Reports. Further, we quickly acceded to the FCC‘s request
that further testing in that band cease as PCS licenses were awarded.

The persons responsible for this license were active in those tests and are expert in Part 5 reporting
requirements to the FCC and other potential users in the band.

In accordance with the rules adopted in FCC GEN Docket NO. 90—312, NYNEX Science and
Technology, Inc. hereby certifies that neither the applicant nor any party to the application is subject
to a denial of federal beneffits pursuant to Section 5301 of the Anti—Drug Abuse Act of 1988.
