Dear Ms. Dortch:

         The First Responder Network Authority (*FirstNet") consents to the application of Motorola
Solutions, Inc. ("MS!") for an experimentallicense to test Land Mobile Radio communications equipment
in the 768—769/798—799 MHz band. The proposedlicense would include testing within a 25 kilometer
radius of two locations in New York City for the period of June 20 to August 31, 2014... MS! states that
the goal is to test in an urban area prototype devices and systems that would enhance land mobile radio
communications use by public safety in the adjacent 700 MHz land mobile radio public safety band. The
testing in the public safety guard band is being requested to ensure that no radio frequencyinterference
occurs to existing land mobile radio systems. The tests do not intend to indicate that any land mobile
operations will permanently be proposed in the guard band.

        FirstNet‘s concurrence is premised on the experimental operations that conform to the following
parameters:

        1) Testing will evaluate prototype equipment in the field, within a 25 kilometer radius of two
           locations: 165 Cadman Plaza, Brooklyn, NY 11201 and 49 35°" St., Long Island City, NY
           11101. The test will transmit broadcast test pattern signals to evaluate the recorded
           coverage in the areas of interest.

        2)    MSI requests authority from the Federal Communications Commission (‘Commission") to
              operate over the 768—769/798—799 MHz bands, which are currently licensed on a nationwide
              basis to FirstNet.

        3)     Operation will begin when the Commission grants the requested license and will continue for
              no longer August 31, 2014.

        4)     MSI has analyzed information in the FCC‘s license databases and states that the proposed
              operation would not interfere or create a significant potential for harmful interference with any
              public safety operations in the 700 MHz band.


        5) Operation of the experiment will not be used in mission—critical operations or in the delivery of
           live transmissionsin duties to protect life, property, or safety.


        6)    MSI recognizes that its experimental operations will be secondary and must not cause
             interference to any operations licensed to FirstNet. MSI further understands that any primary
             operations have no obligation to mitigate interferenceto the experimental operations.


        7)    MSI acknowledges that if any FirstNet operations were to occur in the test area thatits test
             operations must cease to prevent interference to any deployed systems by FirstNet.


        8)    MSI has provided an overall project manager and in case of interference issues, "stop—

        9)    MSI understands that an experimentallicense only permits shared use of the subject radio
             frequencies and that it may have to coordinate with other entities licensed for experimental
             purposes.




      FirstNet concurs with the proposed experimental license for MSI on certain frequencies currently
licensed to FirstNet for purposes of testing as described above. This consent is subject to the FirstNet‘s
ongoing ability to monitor any operations and use of FirstNet‘s licensed spectrum.
