Please explain in the area below why an STA is necessary:
Lemko, Corporation requests grant of experimental licenses consisting of a single carrier in the in the broadband PCS ?C? band (1895-1910 MHz, 1975-1990 MHz) for portions of New Jersey and New Mexico. Military officials at Fort Monmouth have requested a full DMA cellular demonstration be given at their location in New Jersey in mid January. While the frequencies are public PCS frequencies in the United States, they are the frequencies the military uses in Afghanistan and Iraq. The army has stated they are very interested in deploying the systems to these areas as early as March, 2005. In order to meet their time frame, Lemko needs an experimental license for the PCS ?C? band to begin field tests in the New Jersey area in January. The C band frequencies requested in McKinley County, New Mexico are currently not licensed to any cellular carrier. Should a carrier bid for the license via the auction process slated for late January, it will take more than six months for the award, payment and build-out to occur. Therefore, Lemko believes this area to be an ideal location to test desert-like environment operation of the DMA. The C band frequencies in Monmouth and Burlington counties in New Jersey are licensed to NextWave Personal Communications Inc., Debtor-in-Possession. NextWave is not currently offering services in this area, and is in the process of selling or transferring its New York area licenses to Verizon Wireless. This resale and approval process is expected to take several months. It will be several more months before Verizon begins service operation in the Monmouth and Burlington counties. Therefore, Lemko does not believe that the DMA field trial will interfere with any services offered on the PCS C band in that area. Lemko contacted NextWave?s Debtor-in-Possession representative, Mr. Thomas Gutierrez of Lukas, Nace, Gutierrez & Sachs, Chartered, regarding use of the frequencies for trial purposes. Mr. Gutierrez stated verbally that the frequencies are not being used, and he believed NextWave would approve the frequency request for the given areas. Shortly after our conversation the press announced the NextWave and Verizon discussions. Since then, Mr. Gutierrez has not returned any phone calls or e-mail to Lemko.

Lemko desires to conduct technical field tests of its new cellular infrastructure equipment and solution in Monmouth and Burlington counties of New Jersey, and in McKinley county of New Mexico. The tests will validate correct operation of our Distributed Mobile Architecture (DMA) cellular system in various environments and operating conditions. The test equipment will utilize CDMA 1X cellular technology. Lemko intends to place the entire solution in a Humvee to validate that cellular service provided by DMA continues to operate while in a moving or stationary vehicle. This will act as a ?real environment? test for deploying emergency communication services in military and disaster recovery applications. Lemko plans to conduct three phases of tests in each area. Each testing phase would last approximately one week. All three phases would be completed within a 180 day testing time frame. No harmful interference will be caused to any station operating in the field trial area. It is our belief that the highly portable, rugged DMA meets the safety requirements and needs of many government agencies and corporate entities. In addition, its ability to cost effectively deliver cellular service makes Lemko?s solution ideal for rural areas, geographically difficult-to-reach locations and Tribal Lands. Lemko Corporation asks the Commission to move expeditiously on granting this request for experimental licenses in the PCS ?C band? frequencies in Monmouth and Burlington counties in New Jersey and in McKinley County in New Mexico. Lemko believes the experimental license will result in the availability of a system needed by the military. In addition, it will validate commercial viability of a system that can economically serve rural populations and safety organizations.
