FCC Form 442 Exhibit II: Request for Confidentiality Pursuant to Section 0.459 of the Commission’s Rules, James J. Corbalis, III (“Applicant”) requests confidentiality with respect to the submission of Exhibit 1 to the FCC Form 442 being submitted herewith. The following information is submitted pursuant to Section 0.459(b) of the Commission’s Rules: (1) Applicant requests that the information contained in Exhibit I submitted herewith be given confidential treatment. (2) This information is being submitted to the Commission pursuant to submission Applicant’s request for an Experimental Special Temporary Authorization. (3) The information contained in Exhibit I contains detail system and equipment description considered as proprietary in operation of the equipment. Such information is privileged, and is routinely withheld from public inspection. It therefore should be afforded confidential treatment in accordance with Section 0.457(d) of the FCC Rules. (4) Public disclosure of the information contained in Exhibit I would be harmful to the Applicant, and would give a competitor an unfair advantage in the marketplace. (5) Public disclosure of privileged and sensitive information contained in Exhibit I can substantially harm Applicant and its investors in future negotiations with competitors, third party sources of financing, and the marketing of its product. (6) In order to prevent unauthorized disclosure of Exhibit I, Applicant has limited the distribution to persons who have a need for it and who are aware of their sensitive nature. The Applicant has not provided this information to any third parties who are not under an obligation to treat the documents as confidential. (7) As described in response to item number 6, above, the sensitive information contained in Exhibit I is not available to the public or any third parties who are not under an obligation to treat the documents as confidential. (8) Pursuant to Section 0.457(d) of the Commission’s rules the subject material is not routinely available for public inspection and should Page 1 of 2
