Insitu has been in discussions with Sirius XM radio regarding the above referenced application.
Insitu‘s proposed use is outside of the frequencies authorized for use by Sirius XM.
Nevertheless, to assure Sirius XM that Insitu‘s experimental operations will not pose a risk of
harmful interference to Sirius XM‘s customers, Insitu has agreed to the following operational
restrictions on its experimental operations. The conditions below, of course, do not relieve
Boeing of its ongoing obligation to ensure that its experimental operations do not result in
harmful interference to authorized users and to promptly cease operations if harmful
interference results.

First, Insitu‘s fixed Boardman site will operate in its current location with a parabolic reflector
positioned not higher than 50 feet AGL.

Second, the Insitu aircraft will refrain from engaging in any transmissions at altitudes below
1000 feet AGL and will also refrain from engaging in any transmissions if the aircraft flies within
two (2) miles of 1—84.
