Dear Mr. David Gilbert:

Currently, it appears that you are requesting a maximum of 10 mW (peak ERP) for airborne
testing and that you intend to use lower power levels for ground testing.

Are you instead requesting two power levels, 10 mW (peak ERP) for ground only testing in
Arizona, Nevada, New Mexico, Utah and California and a higher power level for airborne
testing only over open ocean areas at least 50 miles offshore from US territory? If so, what is
the higher power level for the open ocean airborne testing?


The items indicated above must be submitted before processing can continue on the above
referenced application. Failure to provide the requested information within 30 days of
August 02, 2004 may result in application dismissal pursuant to Section 5.67 and forfeiture of
the filing fee pursuant to Section 1.1108.
