DE STAATSSECRETARIS VAN ECONOMISCHE ZAKEN EN KLIMAAT Gelezen de aanvraag van Magnitude Space B.V, Gelet op artikel 3 Wet ruimtevaartactiviteiten en artikel 1 van het Besluit ongeleide satellieten; BESLUIT: § 1 Begripsbepalingen Artikel 1 In deze beschikking wordt verstaan onder: a. de staatssecretaris: Staatssecretaris van Economische Zaken en Klimaat; b. ruimtevoorwerp: ieder voorwerp gelanceerd of bestemd om te worden gelanceerd in de kosmische ruimte; c. ruimtevaartactiviteiten: het lanceren, het bedienen van de vlucht, het geleiden van ruimtevoorwerpen en het beheren van ongeleide ruimtevoorwerpen in de kosmische ruimte; d. het beheren van ongeleide ruimtevoorwerpen: alle beheeractiviteiten ten aanzien van een ongeleid ruimtevoorwerp in de kosmische ruimte waarmee geen manoeuvres kunnen worden uitgevoerd om het ruimtevoorwerp op zijn (baan)positie in de ruimte te houden of te wijzigen. e. lage aardbaan: de baan om de aarde tot 2000 kilometer boven het aardoppervlak. f. beheercommunicatie: alle communicatie tussen een grondstation en een ongeleid ruimtevoorwerp gericht op het beheren van ongeleide ruimtevoorwerpen waarvan de Nederlandse staat ten behoeve van Magnitude Space B.V. fihingrechten heeft verworven. § 2 Reikwijdte van de vergunning Artikel 2 Aan Magnitude Space B.V., hierna te noemen: de vergunninghouder, wordt een vergunning verleend voor het beheren van ongeleide ruimtevoorwerpen in een lage aardbaan. § 3 Voorschriften en beperkingen § 3.1 Veiligheid van personen en goederen Artikel 3 het beheren van ongeleide ruimtevoorwerpen 1. Met het oog op de veiligheid van personen en goederen draagt de vergunninghouder bij het beheren van ongeleide ruimtevoorwerpen in de kosmische ruimte ervoor zorg dat: a. de communicatieverbinding voor het beheren van elk ongeleid ruimtevoorwerp gewaarborgd is en vanuit Nederland plaatsvindt; b. de positie van elk ongeleid ruimtevoorwerp in ieder geval eenmaal per dag bekend is; c. er voldoende beheerpersoneel beschikbaar en gekwalificeerd is door opleiding en/of ervaring. Aantal bladen 2 van 4 Plaats en datum Groningen, 24april2018 Nummer : AT-EZK17618925 d. er wordt beschikt over de vereiste vergunning(en) in de zin van de Telecommunicatiewet voor de beheercommunicatie voor elk ongeleid ruimtevoorwerp. 2. Indien er door natuurlijke oorzaken of omstandigheden gedurende een bepaalde periode geen beheercommunicatie met een ongeleid ruimtevoorwerp mogelijk is, wordt de beheercommunicatie na beëindiging van deze periode onverwijld tot stand gebracht. De periode waarin de beheercommunicatie niet mogelijk is, is bij de vergunninghouder bekend en Agentschap Telecom wordt hiervan onverwijld in kennis gesteld. Artikel 4 einde levensduur De vergunninghouder heeft de verplichting om er zorg voor te dragen dat elk ongeleid ruimtevoorwerp aan het einde van de levensduur volledig verbrandt in de dampkring. § 3.2 Bescherming milieu in de kosmische ruimte Artikel 5 Met het oog op de bescherming van het milieu in de kosmische ruimte heeft de vergunninghouder bij het beheren van ongeleide ruimtevoorwerpen de verplichting om er zorg voor te dragen dat: a. de structurele integriteit van elk ongeleid ruimtevoorwerp zodanig is dat deze geen schade veroorzaakt of kan veroorzaken aan het milieu in de kosmische ruimte; b. uiterlijk 25 jaar na lancering elk ongeleid ruimtevoorwerp volledig verbrandt in de dampkring. § 3.3 Financiële zekerheid Artikel 6 1. Ter waarborging van de continuïteit van de wimtevaartactiviteiten, voldoet de vergunninghouder aan het volgende: a. de vergunninghouder verkeert niet in staat van faillissement, noch is een verzoek tot faillietverklaring van de vergunninghouder ingediend; b. aan de vergunninghouder is geen surseance van betaling verleend, noch is door de vergunninghouder surseance van betaling aangevraagd; c. er is geen substantieel beslag gelegd op het vermogen dan wel de bedrijfsmiddelen van de vergunninghouder, en d. de vergunninghouder kan aantoonbaar beschikken over voldoende financiële middelen om de vergunde activiteiten te kunnen uitvoeren. 2. De vergunninghouder informeert de staatssecretaris onverwijld indien hij weet dan wel behoort te weten dat niet kan worden voldaan aan het bepaalde in het eerste lid.

De vergunninghouder heeft en houdt in stand een verzekeringsdekking voor de aansprakelijkheid, voortvloeiende uit de ruimtevaartactiviteiten, ter hoogte van 20.000.000,- euro per gebeurtenis per ongeleid ruimtevoorwerp. De Staat is hiertoe in de polis onvoorwaardelijk en zonder enig voorbehoud als begunstigde vermeld. 2. De vergunninghouder verstrekt jaarlijks, uiterlijk één maand na ontvangst van de nieuwe polis van de aansprakelijkheidsverzekering, aan de staatssecretaris de nieuwe polis en een bewijsstuk van de daarvoor betaalde verzekeringspremie per ongeleid wimtevoorwerp. § 5 Kennisgevingen en correspondentie Artikel 8 1. De vergunninghouder stelt de staatssecretaris onverwijld in kennis van: a. technische en andere wijzigingen en calamiteiten die verband houden met de vergunning, en; b. substantiële wijzigingen in de samenstelling van zijn rechtspersoon en de zeggenschapsverhoudtngen binnen zijn rechtspersoon. 2. Om te kunnen beoordelen of elk toekomstig ongeleid ruimtevoorwerp vanaf 24 april 2018 aan de voorschriften en beperkingen van deze vergunning voldoet, is de vergunninghouder verplicht om ten minste zes maanden voordat de lancering plaatsvindt, de staatssecretaris op de hoogte te stellen van het voornemen van die activiteit. Artikel 9 Kennisgevingen en correspondentie die verband houden met deze vergunning, worden gericht aan Agentschap Telecom van het Ministerie van Economische Zaken en Klimaat te Groningen, tenzij door of vanwege de staatssecretaris anders wordt aangegeven. §6 Slotbepaling Artikel 10 1. Deze vergunning treedt in werking op 24 april 2018 en geldt voor de duur van de ruimtevaartactiviteiten voor één of meerdere ongeleide ruimtevoorwerpen. 2. Indien de ruimtevaartactiviteiten niet langer plaatsvinden, eindigt de vergunning.

Deze vergunning treedt in werking een dag na dagtekening van deze brief. Gebruik (nog) niet in lijn met de voorschriften Tijdens de audit is geconstateerd dat de volgende stukken nog niet zijn opgeleverd: • het testrapport van de Hiber-1 en Hiber-2; • het betalingsbewijs van de aansprakelijkheidsverzekering voor de Hiber-1 en H i ber-2. Ik wijs u er op dat ingevolge artikel 3, vierde lid van de Wet ruimtevaartactiviteiten, deze vergunning wordt verleend onder de voorwaarden van het hebben en in stand houden van de hoogst mogelijke dekking voor de aansprakelijkheid voortvloeiende uit ruimtevaartactiviteiten waarvoor de vergunning is verleend. Graag zien we uiterlijk een maand voor de beoogde lancering van de Hiber-1 en Hiber-2 het testrapport en het betalingsbewijs van de aansprakelijkheidsverzekering van de desbetreffende satelliet tegemoet. THE STATE SECRETARY FOR ECONOMIC AFFAIRS AND CLIMATE Having read the application from Magnitude Space B.V., Considering Article 3 of the Space Activities Act and Article 1 of the Unguided Satellites Decree; DECIDES: § 1 Definitions Article 1 In this decision, the following definitions apply: a. the State Secretary: State Secretary for Economic Affairs and Climate; b. space object: any object launched or intended to be launched into outer space; c. space activities: launching, operating the flight, guiding space objects and managing unguided space objects in outer space; d. managing unguided space objects: all management activities with regard to an unguided space object in the outer space with which no manoeuvres can be performed to keep or change the space object in its (orbit) position in space. e. low-earth orbit: the orbit around the earth up to 2000 kilometres above the earth's surface. f. management communication: all communication between a ground station and an unguided space object aimed at managing unguided space objects, of which the Dutch state has acquired filing rights on behalf of Magnitude Space B.V. · · § 2 Scope of the license Article 2 Magnitude Space B.V., hereinafter referred to as: the licensee, is granted a license to manage unguided space objects in a low-earth orbit. § 3 Regulations and restrictions § 3.1 Safety of persons and goods Article 3 managing unguided space objects 1. With a view to the safety of persons and goods, the licensee shall ensure the following when managing unguided space objects in the outer space: a. the communication link for managing every unguided space object is guaranteed and takes place from the Netherlands; b. the position of every unguided space object is known at least once a day; c. sufficient management personnel is available and qualified by training and/or experience. If, due to natural causes or circumstances, no management communication with an unguided space object is possible for a certain period of time, the management communication shall be established without delay after the end of this period. The period in which management communication is not possible is known to the licensee and the Telecommunications Agency is informed of this immediately. Article 4 End of lifespan The licensee has the obligation to ensure that every unguided space object burns completely in the atmosphere at the end of its lifespan. § 3.2 Protection of the environment in outer space Article 5 With a view to protecting the environment in outer space, the licensee has the obligation to ensure that: a. the structural integrity of any unguided space object is such that it does not cause or can cause damage to the environment in the outer space; b. no later than 25 years after launch, any unguided space object will be completely burnt in the atmosphere. § 3.3 Financial security Article 6 1. To guarantee the continuity of the space activities, the licensee meets the following requirements: a. the licensee is not in a state of bankruptcy, nor has a request been submitted for bankruptcy of the licensee; b. no suspension of payment has been granted to the licensee, nor has the licensee applied for a suspension of payment; c. there is no substantial claim on the capital or the assets of the licensee, and d. the licensee can demonstrate sufficient financial resources to carry out the licensed activities. 2. The licensee shall inform the State Secretary immediately if he knows or should know that the provisions of the first paragraph cannot be complied with.

The licensee has and maintains an insurance cover for the liability arising from the space activities, amounting to 20,000,000 euros per event per unguided space object. The State is unconditionally and unreservedly mentioned as a beneficiary in the policy. 2. At the latest one month after receipt of the new policy for liability insurance, the licensee shall provide the State Secretary the new policy and proof of the insurance premium paid for this per unguided space object. § 5 Notices and correspondence Article 8 1. The licensee shall immediately inform the State Secretary of: a. technical and other changes and emergencies related to the license, and; b. substantial changes in the composition of his legal entity and the control relationships within his legal entity. 2. In order to assess whether each future unguided space object complies with the requirements and restrictions of this license from 24 April 2018, the licensee is obliged to inform the Secretary of State at least six months before the launch takes place of the intention of that activity. Article 9 Notices and correspondence related to this license will be sent to the Telecommunications Agency of the Ministry of Economic Affairs and Climate in Groningen, unless otherwise indicated by or on behalf of the State Secretary. § 6 Final provision Article 10 1. This license shall enter into force on 24 April 2018 and shall apply for the duration of the space activities for one or more unguided space objects. 2. If the space activities no longer take place, the license will end.

I would like to point out to you that in accordance with Article 3, paragraph 4 of the Space Activities Act, this license is granted under the conditions of having and maintaining the highest possible coverage for the liability arising from space activities for which the license has been granted.
