Dear Mr. Young:

When HNS License Sub, LLC (?Hughes?) added limited market authority to its license for Call Sign
WE2XEW in 2009, it had a specific market study in mind, but sought authority with flexibility to allow it to
use a small number of terminals for future market studies in response to other anticipated customer
requirements. The grant included a condition limiting Hughes?s market studies under the WE2XEW
license to six terminals.

To date, as evidenced by the 2010 and 2011 annual progress reports, Hughes has not utilized the market
capability for new customer requirements in the last year or two. Hughes, however, would still like to
retain the flexibility to utilize terminals within its authorization for limited market studies of up to six
terminals without having to seek a modification of its authorization where no technical changes to current
authority are needed. We understand that the annual reporting condition would thus continue to apply,
and Hughes is prepared to comply with that condition.
