ATTACHMENT A

HNS License Sub, LLC (“HNS”), FCC Registration Number 0012369286, is the licensee
of experimental license WC9EXT.1 This application seeks Federal Communications
Commission (“FCC” or “Commission”) consent to the pro forma transfer of control of HNS. On
February 21, 2006, a transaction was effectuated pursuant to which control of HNS was
transferred from SkyTerra Communications, Inc. (“SkyTerra”) to Hughes Communications, Inc.,
f/k/a SkyTerra Holdings, Inc. (“HCI”). HNS inadvertently failed to request consent from the
Commission with respect to WC9EXT prior to this transfer. This omission recently came to the
attention of HNS’s regulatory counsel and the instant application is being filed to seek the
requisite consent. There has been no change in the ultimate ownership of HNS because HNS
continues to be controlled by five affiliated entities, Apollo Investment Fund IV, L.P., Apollo
Overseas Partners IV, L.P., AP/RM Acquisition, AIF IV/RRRR, LLC, and ST/RRRR, LLC.
Accordingly, the transaction for which Commission consent is sought herein constitutes a pro
forma transfer of control.

The instant application requires HNS and HCI to certify that the transfer of control for
which approval of the Commission is sought will not be consummated until such time as FCC
approval is obtained. As noted above, HNS inadvertently failed to request consent from the FCC
prior to the transfer of control. Accordingly, HNS and HCI are unable to make the required
certification.

FCC records incorrectly list “Hughes Networks Systems, sub LLC” as the licensee of
WC9EXT. HNS respectfully requests that the Commission update its records to reflect that the
legal name of the licensee of WC9EXT is “HNS License Sub, LLC.”
