These frequencies were originally chosen for the Predator Unmanned Air Vehicle (UAV)
because the C Band frequencies were less susceptible to environmental factors such as weather
patterns. These higher frequencies were also chosen in part because they experienced less
traffic and use. Our company is able to fly the Predators on a non-interference basis (NIB)
because all flights are pre-coordinated with local frequency managers, and pre-flight frequency
surveys are conducted to ensure the frequencies are free of traffic. Runways are required for the
purpose of take-off and landing of the Predator UAV. This license is being requested under 47
CFR, Parts 5.3 (b)(d) (f). The demonstrations performed for the Bureau of Immigration and
Customs Enforcement (under the Dept of Homeland Security) that were originally performed on
an STA are being continued for a longer duration of time. We believe that following this long
term demonstration of the Predator’s surveillance capabilities that BICE will purchase its own
Predator System.
