Dear Mr. Burtle:

       On May 19,2009, Garmin International ("Applicant") filed an application for experimental special
temporary authority to perform certain testing on aircraft using facilities in Olathe, Kansas. Applicant
proposed to transmit on a number of frequency bands, including the 1626.5-1 660 MHz band. These
frequencies are uplink frequencies authorized for and operationally in use by SkyTerra Subsidiary LLC
("SkyTerra"). SkyTerra is the licensee of AMSC-I and SkyTerra 1, United States satellites licensed by the
Comtn~ssionto provide Mobile Satellite Service ("MSS") in the L band, and provides, inter aka, critical
communications services to public safety users.

        In discussions occuning shortly after the filing of the application regarding the reduction of potential
interference to SkyTerra, the Applicant stated it was not currently performing a test in the frequency band
relevant to SkyTerra and would contact SkyTerra prior to performing any testing in that band. By this letter,
SkyTerra requests that the Office of Engineering and Technology ("OET") formally condition the Applicant's
authorization on the provision of such notice to SkyTerra prior to Applicant's use of the relevant frequency
band.
