This application is for a network operating in the 3.65-3.7 GHz band regulated in Part 90 of the Rules. For your reference, the original version of this filing included a request for additional frequencies in the 4.9 GHz public service bands, but in the current version of the filing these frequencies have been removed, so this filing is for 3.65-3.7GHz operation only. Fujitsu is requesting a grant date no later than the first week in February. The reason for this request is that the 3.65GHz experimental license is required for testing and pre-staging the wireless network in preparation for the trial with Sacred Wind Communications (SWC). Sacred Wind Communications serves the Navajo Nation by providing wireless communications services. Fujitsu is under severe time constraints to meet a mid-February 2008 trial start date with SWC. As the FCC is aware, there is extreme sensitivity to the success of the SWC trial and deployment at the government level because of the need to bring life-line service to the underserved Navajo Nation.
