Explanation
Please explain in the area below why an STA is necessary:
Flarion requests authorization, pursuant to Section 5.61 of the Commission's Rules, to operate an experimental prototype from March 11, 2003 through March 20, 2003. Flarion seeks to operate its equipment, which the Commission has already authorized it to operate on a permanent experimental basis at its headquarters in Bedminster, NJ and New York, NY (Call Sign WC2XLF), on a temporary basis for demonstration at the CTIA Wireless 2003 Convention in New Orleans, Louisiana. Flarion is seeking STA because the scope and duration of its proposed operation warrant only temporary authority under Part 5 of the Commission's rules. Flarion's request for STA is supported by good cause. Flarion is developing a new broadband mobile data communications system in the 700 MHz band. Flarion has been invited to demonstrate the performance and capabilities of the system to parties interested in Flarion's technology. Flarion seeks to develop products that will ultimately result in the more efficient use of the radio spectrum. Demonstrating the device before interested parties allows Flarion to receive critical feedback, enabling the company to continue to make modifications to its system before marketing the device. To this end, Flarion seeks the feedback of experts to improve the responsiveness of the unit before committing additional resources to full-scale commercial production. With the exception of location, the instant STA request is identical to similar STAs the Commission granted for Flarion.

The mast extends to a maximum height of 40 feet above ground level (AGL). The truck is located in the immediate vicinity of taller buildings and is completely shielded from all air traffic by the surrounding buildings. It is evident beyond all reasonable doubt that the truck, mast and antenna, so shielded, do not adversely affect safety in air navigation. Thus, under section 17.14(a) of the FCC Rules, the proposed structure is exempt from notice to the FAA.
