Ms. Nguyen:
you had asked FCL Tech to submit a written consent from Sirius XM Radio satellite operator for its operations
in the 2305-2360 MHz under the above-referenced STA application. SiriusXM has consented to the proposed
operations provided FCL Tech notches out the 2310 -2355 MIlz band (the SDARS band plus a 10 MHz guard
bànd on either side) from the frequencies to be used for the experimental operation. Please let me know if I
should amend the application or whether you would prefer to make it a condition of the authorization. Please
let us know ifyou have any questions.
Sincerely,
Chris

Chris - I heard bacl< from our engineer and we are concerned that your client's proposed operations would disrupt
service to SiriusXM's subscribers in a densely populated area with many busy roads and highways where our service is
often used. SiriusXM cou[d consent to the application only if it can be amended to notch-out the 23]-0 - 2355 MHz band
(the SDARS band plus a 10 MHz guard band on either side) from the frequencies to be used for the experimental
o pe ratio n.

Subject: Request for Consent to Use the 2305-2360 MHz Band

Jim:
Hope all is well. As I mentioned in my voice mail, our client FCL Tech has filed for an STA to test potential
new communications applications and equipment in a controlled, low-altitude airborne environment in
Camarillo, California. The FCC has asked that we obtain Sirius XM's consent before using the 2305-2360
MHz band. This email requests your consent. I have attached the application for your reference. Please let me
know if you have any questions.
Sincerely,
Chris
