For the reasons set forth below, we believe that the dismissal without prejudice of the STA application
(File No. 0302-EX-ST-2008) of Datron World Communications, Inc (hereafter ?Datron? or ?applicant?) on
July 21, was in error and that the application should be reinstated.

On June 18, 2008, Jose Trevino sent correspondence to the applicant for the above-referenced
application requesting additional information and clarification with respect to that application. On June
19, 2008, undersigned counsel for applicant filed a reply to Mr. Trevino using the ELS correspondence
system. In that reply, counsel indicated that the application had not yet been completed, but that when it
was completed and in final form the application would contain the requested information. On that same
date, the applicant filed Form 159 with the necessary filing fee (paid by credit card). On the following
day, the applicant took the necessary steps in the ELS to ?complete? the application.

The completed application provided the requested information. First, it provided the additional detail
about the application that had been requested. Second, the requested frequencies were modified and no
longer included the frequencies for which Mr. Trevino stated that the ERP was ?too big.?

On July 21, 2008, James Burtle dismissed the application without prejudice. The letter of dismissal
stated that the reason for the dismissal was the failure to respond to the June 18, 2008, correspondence
of Jose Trevino within thirty days. Indeed, applicant?s counsel had used the ELS system to reply to Mr.
Trevino on June 19. Further, shortly therafter, and within the thirty-day period, the application was
completed and the completed version addressed all the issues raised by Mr. Trevino.

Accordingly, Datron respectfully requests that the application by reinstated, reviewed and granted.
