FCC Form 405 — Application for Renewal of Experimental License Call Sign: WA2ZXMY — King Ranch, Texas Dear Mr. Marrangoni: Submitted for filing, on behalf of Diversified Communication Engineering, Inc. ("DCE"), is an original and one copy of an FCC Form 405, Application for Renewal of DCE‘s referenced experimental license. The requisite $45.00 filing fee is attached. DCE notes that its experimental license expires today, January 8, 1998. DCE recognizes that Section 5.55(d) of the Commussion‘s rules specifies that renewal applications shall be filed sixty days prior to the expiration date. However, strict application of that rule would be inequitable in DCE‘s situation. As the Experimental Licensing Branch is aware, DCE originally requested a two year experimental license period. After negotiations with Commission staff, the time frame requested was modified to six months, and its license was issued for six months. DCE conducted initial testing at the King Ranch test location the week of October 6, 1997, and is simultaneously submitting its Progress Report detailing its test results. To the extent necessary, DCE requests waiver of Section 5.55(d). Waiver is justified 69871.1

In addition, the sixty day renewal application window closed shortly after the experiment had been concluded and the need for further testing determined. Finally, DCE also notes that it is submitting a facsimile signature on this Form 405. The original signature will be filed with the Commission tomorrow, Friday, January 9, 1998. To the extent necessary, DCE also respectfully requests a waiver of Section 5.53(f) of the Commission‘s rules. Please contact Carmen A.
