You are advised that the Commission is unable to grant your application for the facilities requested. The use of band assignments thru the FAA DME and Radar bands presents a risk of RFI to multiple FAA facilities and aircraft. Although the proponent attempted to notch out 1030/1090 MHz operations, the width of the notch may be inadequate. This is the type of request that the FAA needs to have sent for pre-coordination process. Based upon our previous comments, the FAA still non-concurs with 0966-EX-ST-2015. The user must pre-coordinate with the FAA to use discrete frequencies for each sub-band.
