                                  DISMISSED-WITHOUT PREJUDICE

Dear Mike Matsick,

This refers to application, File No. 0996-EX-ST-2015, for an experimental authorization.

You are advised that the Commission is unable to grant your application for the facilities requested. The
use of band assignments thru the FAA DME and Radar bands presents a risk of RFI to multiple FAA
facilities and aircraft. Although the proponent attempted to notch out 1030/1090 MHz operations, the
width of the notch may be inadequate. This is the type of request that the FAA needs to have sent for
pre-coordination process. Based upon our previous comments, the FAA still non-concurs with
0966-EX-ST-2015. The user must pre-coordinate with the FAA to use discrete frequencies for each
sub-band.
