                          Explanation of Modification Application

          Caterpillar, Inc. has filed the instant modification application to add 60-72 MHz to

the list of authorized frequencies on which it can conduct electromagnetic compatibility

(“EMC”) immunity testing at its proving grounds in Tucson, Arizona. See FCC File No.

0003-EX-PL-2007. Caterpillar received the consent to conduct its proposed EMC

testing at its Tucson proving grounds on television channel 3 (60-66 MHz) from

KTVK(TV), channel 3, Phoenix, AZ in mid-September 2007. (consent letter attached).

Similarly, Caterpillar also received the consent to conduct its proposed EMC testing at

its Tucson proving on television channel 4 (66-72 MHz) from KVOA(TV), channel 4,

Tucson, AZ in mid-September. (consent letter attached).

          Unfortunately, Caterpillar’s then pending application for an experimental

authorization to conduct EMC testing at the Tucson proving ground was never amended

to request these additional frequencies (60-72 MHz) nor were the attached consent

letters from KTVK and KVOA submitted in a supporting exhibit. By filing this

modification application, Caterpillar seeks to remedy this oversight by securing FCC

approval to add 60-72 MHz to the list of approved frequencies for EMC testing at the

Tucson proving grounds.
