Dear Mr. John Kennedy:

This statement is in response to your message received today containing the following two
questions:

Will BeamReach Networks charge fees for the equipments or for services related to the use of
the equipments under this experimental license?

No.

Will BeamReach Networks retain ownership during and after testing of the equipments under
this experimental license?

Yes.

BeamReach Networks is developing broadband wireless equipment and is seeking authorization
to test this equipment over-the-air and demonstrate its operation to potential customers of the
equipment, specifically WCS licensees. BeamReach Networks will retain ownership of the
equipment during such testing and demonstration. BeamReach Networks does not intend to
charge fees for its products or services related to the use of products operated under
experimental license. Furthermore, it is BeamReach Networks' understanding that charging fees
is not permitted under the Commission's rules governing experimental radio services.
