                                      Request for Waiver

The confidential version of Exhibit I to this application provides technical equipment and
antenna information for the experimental testing contemplated by this license request. However,
certain equipment data is not provided, even in the confidential version of the technical data
exhibit, because the proposed equipment to be used during testing is prototype equipment that is
still under development by multiple manufacturers. Specifically, Applicant is unable to provide
the equipment manufacturer and model and certain technology information, such as mean peak,
frequency tolerance, antenna orientation in the horizontal plane.

To the extent that the Commission may seek more specific equipment and antenna information
under section 5.55(c)(1) of its rules, Applicant seeks a waiver of that rule. Pursuant to
Commission rule section 1.925, grant of a waiver would be in the public interest, as it would
allow Applicant to conduct advance testing on various types of equipment with different mean
peak, frequency tolerances, and antenna orientations in preparation for the future development of
5G equipment and in anticipation of cutting-edge 5G services. Moreover, the very purpose of
the experimental licensing rules is to facilitate testing, experimentation and research for future
projects in the manner described by Applicant. Strict application of Commission rule section
5.55(c)(1) in this instance to require specific equipment information before grant of the license
would delay Applicant’s ability to conduct early 5G testing and inform the development of 5G
industry standards, effectively undermining the purpose of the Part 5 experimental licensing
rules.
